You will not be allowed to use Chapter 7 bankruptcy if you have received a bankruptcy discharge in the last six to eight years (depending which type of bankruptcy you filed). You may also not be allowed to file for Chapter 7 if your income level is over your state’s median income level for your household size and you do not pass the “Mean’s Test.”
